Terms of Service
These terms are an agreement between you and The Gippy Geek (“we”, “us”), the operator of Carers Portal at carersportal.me (the “Service”). By creating an account or using the Service you agree to them. If you are accepting on behalf of an organisation, you confirm you have authority to bind it. Our Privacy Policy forms part of these terms.
1. What the Service is — and isn’t
Carers Portal is a record-keeping and coordination tool. It lets a participant and the people in their circle record and share information about day-to-day care. It is not a medical device, does not provide medical, clinical or legal advice, and does not replace the judgement of qualified professionals. In an emergency, call 000.
2. Accounts and access
- You must provide accurate account details and keep your sign-in credentials secure. You are responsible for activity under your account.
- Access to a participant’s records is granted by the participant, their authorised nominee, or an administrator of their organisation. You must only access records you have been authorised to see, and only for the purpose of that participant’s care.
- Organisations are responsible for confirming that nominees and workers they add have the authority and any required clearances (for example an NDIS Worker Screening Check) before granting access.
- Tell us immediately at privacy@carersportal.me if you believe an account has been compromised.
3. Acceptable use
You must not:
- access, copy or share a participant’s information beyond what their care requires;
- enter false, misleading or defamatory records;
- upload malicious code, probe or overload the Service, or attempt to bypass access controls or tenant isolation;
- use the Service to harass anyone or to break any law, including the Privacy Act 1988 and NDIS legislation;
- resell or white-label the Service without our written agreement.
4. Your content
Records you enter remain the property of the participant (or the organisation, where the organisation is the account holder). You grant us a licence to store, process, back up and display that content solely to provide the Service. We do not claim ownership of it and we do not use care records to train models or for advertising.
You warrant that you have the right, including the participant’s or nominee’s consent, to enter any personal or health information you record.
5. Plans, fees and payment
- Some features may be offered on paid plans. Prices are shown on the website in Australian dollars and include GST unless stated otherwise.
- Payments are processed by Stripe. Subscriptions renew automatically until cancelled; you can cancel at any time and the plan runs to the end of the paid period.
- We may change prices with at least 30 days’ notice by email. Continued use after the change takes effect is acceptance of the new price.
- Fees are non-refundable except where required by the Australian Consumer Law or stated otherwise in writing.
6. Availability, backups and changes
We aim to keep the Service available at all times but do not guarantee uninterrupted access. We take automated backups and store data in Australia. We may change, add or remove features; if a change materially reduces the Service we will give reasonable notice. You are responsible for exporting any records you need to keep outside the Service.
7. Suspension and termination
You may close your account at any time. We may suspend or terminate access if you breach these terms, if required by law, or if continued access would put a participant or the Service at risk. On termination we retain and then delete data as described in the Privacy Policy, and we will provide a reasonable opportunity to export records first where the law allows.
8. Intellectual property
The Service, its software, design and branding are owned by us or our licensors. These terms do not transfer any of that to you. Feedback you give us may be used to improve the Service without obligation.
9. Australian Consumer Law and liability
Nothing in these terms excludes any guarantee, right or remedy you have under the Australian Consumer Law or other law that cannot be excluded. To the extent permitted by law:
- the Service is provided “as is”, and we do not warrant that records entered by users are accurate or complete;
- we are not liable for any indirect or consequential loss, or for loss arising from decisions made in reliance on records in the Service;
- our total liability to you in connection with the Service is limited to the fees you paid us in the 12 months before the claim, or, where no fees were paid, to re-supplying the Service.
10. Privacy and security incidents
We handle personal information as described in our Privacy Policy. If we become aware of a data breach likely to cause serious harm we will notify affected people and the OAIC as required by law. Organisations using the Service agree to cooperate with us in any such notification.
11. Governing law and disputes
These terms are governed by the laws of Victoria, Australia. If a dispute arises, contact us first at privacy@carersportal.me and we will try in good faith to resolve it within 30 days before either party takes further action. The courts of Victoria have non-exclusive jurisdiction.
12. Changes to these terms
We may update these terms. We will post the new version here and update the date above. For material changes we will notify account holders by email or in the portal at least 14 days before they take effect. Continued use after that date is acceptance of the updated terms.
